Giveaway Promotion

Eligibility

These terms and conditions (“Terms and Conditions”) apply to the Giveaway related to the licensed clothing product branded Ubisoft Assassin’s Creed 15th Anniversary or Assassin’s Creed Mirage and the unique QR code attached to the product (“the Product”). Upon registering the Product by scanning the unique concealed QR code attached to it and providing your details as required on the landing page where the unique QR code redirects you (“Landing Page”), you (“the Participant”) will be eligible to claim an Offer or Gift from the Ubisoft brand or a participating licensed Product manufacturer. This offer only applies to you and is uniquely referenced to that Product which has its own unique QR code, which can only be used once and may be deactivated following redemption.

1. The Product Registration Giveaway (hereafter referred to as “the Giveaway”) is promoted by UBISOFT EMEA SAS whose registered address is at 2 avenue Pasteur, 94160 Saint-Mandé, France (“the Promoter”). The Giveaway is administered on Promoter’s behalf by Fabacus Services Limited, 12 Soho Square - 2nd Floor, London, UNITED KINGDOM W1D 3QF (“the Administrator”).

The Giveaway begins October 28, 2022 at 12:01:00 AM British Summer Time ("BST") and ends on October 28, 2024 at 11:59:59 PM BST or at the point at which all Gifts (as defined below) are distributed, whichever is sooner (“Giveaway Period”). Participation in the Giveaway is only open to legal residents of the United Kingdom, 50 United States (excluding Guam, Puerto Rico and all other U.S. territories and possessions), Columbia and Columbia, and Canada (excluding Quebec) physically located and residing therein. Void where prohibited. Participants must be of the age eighteen (18) or older. Entries submitted after this time will not be considered and will be ineligible to receive a Gift.

2. The Giveaway is open to individuals aged 18 years or over, excluding employees and their immediate families (defined as parents, siblings, children & spouse regardless of where they live) of the Promoter or Administrator, their affiliated companies, their agents, or anyone professionally connected with the Giveaway.

3. When applicable, the Giveaway begins and ends as designated on the Landing Page for Offers and Gifts (“the Giveaway Period”). Any Product registrations before or after these times will be considered ineligible for the applicable Offers and Gifts in that Giveaway Period. Proof of purchase may not be required at the time of Product registration; however, Promoter and Administrator reserve the right to request proof of purchase during your participation if such proof, in the sole discretion of Promoter and Administrator, becomes necessary. No proofs of purchase will be returned to Participant by Promoter nor Administrator. The Giveaway is void where prohibited. Quebec is excluded from the Giveaway.

Submission Process / How to Participate

4. Participants that scan the unique QR Code attached to the Product (outlined in Appendix A) using a mobile device or other capable device during the Giveaway Period, follow instructions on the Landing Page to register and submit any additional information as required for participation will be entered into the Giveaway. The QR code on the outer packaging provides further information around the Giveaway. All Participants are subject to all notices posted online including but not limited to the Administrator’s Cookie Policy and Privacy Policy. All personal information provided during participation in the Giveaway must be provided by someone 18 years of age or older. Participants who successfully followed the instructions on the Website will earn one (1) Gift (detailed below). Limit of one (1) Gift per qualifying purchase, per email address throughout the Giveaway Period.

5. The Promoter and Administrator reserve the right to verify the eligibility of all Participants.

6. Incomplete, incorrect, or otherwise invalid submissions will not be considered.

7. The Promoter and Administrator reserve the right to de-activate a unique QR code without advance notice if it is reused, shared, or misused by a Participant.

8. Bad faith or fraudulent submissions will be invalidated. Submissions generated by script, macro or other automated means and submissions by any means which subvert the submission process will be void.

9. The Promoter reserves the right to exclude Participants and withhold the Offers and Gifts for violation of any of these Terms and Conditions or for lack of eligibility. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Promoter and Administrator reserve the right to seek damages from any such person to the fullest extent permitted by law. Promoter’s and Administrator’s failure to enforce any of these Terms and Conditions shall not constitute a waiver.

10. The decision of the Promoter as to eligibility is final and at Promoter’s sole discretion, subject only to the eligibility guidelines herein.

11. The Promoter and Administrator will not be held responsible or liable for any technical, hardware, software, server, website or other failures or damage of any kind, to the extent that this prevents the Participant from or otherwise obstructs the Participant to enter in the Giveaway. Submissions made by fax, telephone or email will not be accepted. Illegible, incomplete or altered submission forms will be deemed void, as will submissions not completed in accordance with these Terms and Conditions.

Gifts

12. The Offers and Gifts are as designated on the Landing Page. Participant will receive one or several Offers and/or Gifts among the Offers and Gifts displayed on the Landing Page, which are:

Total estimated retail value of Offers and Gifts : 5,000$

Participant will be contacted on the email address used to enter the Giveaway to receive their Offers or Gifts. Conditions as well as territorial and/or age restrictions may apply to Offers and/or Gifts. Creation of a Ubisoft Account and purchase of the Game Assassin’s Creed Valhalla may be required to access some Gifts.

13. There are no cash alternatives to the Offers and Gifts. The Offers and Gifts are non-transferable. Promoter and Administrator wish to advise Participants in advance that some Offers and Gifts may not be available in some parts of the world. ALL GIFTS ARE AWARDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND.

14. In the event of unforeseen circumstances, the Promoter reserves the right to offer an alternative gift of equal or greater value should an original gift become unavailable.

15. The values of any Offers and Gifts are as designated or is the ordinary market or retail value. Participants are responsible for all taxes and fees and phone service charges associated with receipt and/or use of a Gift.

Privacy and Data Protection

16. Any personal data relating to Participants will be used in accordance with the Data Processing Appendix signed between Promoter and Administrator.

17. The Administrator collects and processes on behalf of Promoter, Participant’s personal data to allow their participation in the Giveaway in order to enable them to claim an Offer ad Gifts. The processing of Participants’ personal data is necessary to perform the contract they have entered into with Promoter by accepting the Terms and Conditions of the Giveaway. Participants’ personal data will be accessible by the Administrator and the Promoter, Promoter’s affiliates and will be stored until the end of the registration of the Giveaway. Promoter may transfer their personal data to non-European countries that ensure an adequate level of protection according to the EU Commission or within the framework of the standard data protection clauses adopted by the EU Commission here.

Participant can exercise their right regarding their data and request a copy, the deletion or rectification of their data, object to or request the restriction of their processing, and/or receive their information in portable form by contacting Administrator’s data protection officers here: info@Fabacus.com. Your request will be handled in cooperation with Promoter’s data protection officers. After contacting protection officers, if Participants are not satisfied with the way their request were handled, Participants may address a complaint to the regulatory authority of their country.

Redemption

The Gift will be emailed directly to the address provided on the registration form in the form of a digital code. Terms and restrictions of the Giveaway applies. The Giveaway will be in effect according to the eligibility terms of paragraph one. Promotor and Administrator are not responsible for any computer related malfunction that prevents the recipient from accessing entry or receiving their Gift via any form of delivery.

General

18. Except where expressly stated to the contrary, images, graphics, content, logos, trademarks, and any and all other intellectual property appearing on this website or otherwise in connection with the Giveaway are the property of Promoter, Administrator, or are used with permission of third parties and may not be copied, modified or used without the prior written consent of the respective owner. Participants should not share or copy any of the material made available through the Giveaway or reproduce/rebroadcast any of the images, recordings or material without specific, advance, written permission from the respective owner.

19. By participating, you agree to release and hold harmless Promoter, Administrator, and their respective parents, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and gift suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Giveaway or receipt or use or misuse of any Gift.

20. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Participant, printing errors or by any of the equipment or Giveaway associated with or utilized in the Giveaway; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the submission process or the Giveaway; (4) technical or human error which may occur in the administration of the Giveaway; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participation in the Giveaway or receipt or use or misuse of any Gift. Promoter and Administrator are not responsible for misdirected or undeliverable submissions or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Promoter and Administrator are not responsible for any typographical/other error in submissions, or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Giveaway. Except where prohibited, participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any gift awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts of France; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participation in this Giveaway, but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

21. By participating in the Giveaway, Participants will be deemed to have read and accepted these Terms and Conditions. Any participant who enters or attempts to enter the Giveaway in a manner, which in Promoter’s determination is contrary to these rules or by its nature is fraudulent or unjust to other entrants including without limitation tampering with the operation of the Giveaway, cheating, hacking, deception or any other unfair playing practices such as intending to annoy, abuse, threaten or harass any other entrants or Promoter and/or any of its agents or representatives, or who submits an illegible or incomplete entry may be rejected from the promotion at Promoter’s sole discretion. In the event that the Giveaway is, or Promoter believes the Giveaway may be, challenged by any legal or regulatory authority, Promoter reserves the right to discontinue or modify the Giveaway, or to disqualify individuals residing in the affected geographic areas.

22. Except where prohibited, you agree that all issues concerning these Terms and Conditions and the Giveaway shall be governed by the laws of France, without giving effect to any choice of law or conflict of law rules. Notwithstanding the foregoing, you additionally enjoy the protection afforded to you by mandatory provisions of the law of your country of residence. The Giveaway is subject to all applicable international, federal, state, and local laws and regulations and is void where prohibited by law. Giveaway is void where taxed, prohibited or restricted by law. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision and these rules shall otherwise remain in effect. Nothing in these Official Rules shall be deemed to exclude or restrict any of the winner's or the participant's statutory rights as a consumer.
